About the Form 1023 Application Service.

Who files Form 1023 instead of Form 1023?
Form 1023 is for 501(c)(3) charitable, religious, and educational organizations. Form 1023 covers other tax-exempt categories: 501(c)(3) social welfare, 501(c)(5) labor and agricultural, 501(c)(3) business leagues and chambers of commerce, 501(c)(7) social and recreational clubs, and several smaller categories.
How long does IRS Form 1023 review take?
Currently 3 to 9 months from receipt, depending on the IRS examiner's queue and whether they send development letters. Add 1 to 2 months if the examiner requests additional information.
What is the IRS user fee for Form 1023?
$600. This is a flat fee regardless of the subsection or projected revenue. It is paid through Pay.gov at the time of submission and is not refundable if the application is denied.
Do I need to file Form 8976 separately?
Only 501(c)(3) social welfare organizations. They must file Form 8976 (Notice of Intent to Operate Under Section 501(c)(3)) within 60 days of formation. The Notice is a separate filing from Form 1023 and is required even if you have not yet applied for recognition.
Will my organization be public once recognized?
Yes. Approved Form 1023 applications and the resulting determination letters are public records, available through the IRS Tax Exempt Organization Search. Donor information is not public for most 501(c) categories outside (c)(3).
Can a 501(c)(3) engage in political activity?
501(c)(3) organizations can engage in some political activity as long as it is not their primary purpose. The line is fuzzy in practice. We do not advise on political-activity limits, only the application itself.
