Key requirements: written disclosure to the candidate (a separate document), candidate authorization, pre-adverse-action notice if you decide not to hire based on the report, and final adverse-action notice. State and city laws (ban-the-box, fair-chance laws, salary-history bans) add more requirements.

What are ban-the-box laws?
State and city laws that restrict when in the hiring process an employer can ask about criminal history. Different rules in 35+ states and cities.
Are there state-specific compliance issues?
Yes. California, New York, Illinois, and many cities have specific rules. Our partners handle this.
Can I run a credit check?
Only in certain roles (financial, executive) and only in states that permit it. Partners verify this per role.
How long do checks take?
National criminal: 1 to 3 business days. County criminal: 1 to 7 days. Employment verification: 2 to 7 days. Motor vehicle: same day in most states.
What if the candidate disputes the results?
FCRA requires a dispute process. Partner providers handle this; you must wait until disputes are resolved before adverse action.
Adverse action?
If you decide not to hire based on the report, FCRA requires a pre-adverse-action notice (with a copy of the report), then a final adverse-action notice. Partners provide templates.
Drug screening?
Yes, through partner providers. Note state laws on marijuana use that affect this.
