What is the likelihood-of-confusion test?

What about common-law trademarks?
A common-law trademark is an unregistered mark with rights in its geographic area of use. Common-law marks can defeat a federal application within their territory. Critical to find - Google searches do not catch them all.
What if my mark is descriptive?
Descriptive marks (Cold Beer for beer) are refused under § 2(e). Suggestive marks (Cool Breeze for beer) are acceptable. We score on the descriptiveness spectrum and suggest reframings.
Can I file before the search is done?
You can. But you risk paying filing fees + getting a fatal refusal. Pre-filing search costs are 1/3 the cost of an Office Action response. Always search first.
Does an attorney opinion letter help?
Yes - required for: (a) trademark insurance underwriting, (b) M&A diligence (acquirer wants opinion), (c) defending against bad-faith claims later. Optional for solo founders but valuable.
