Which states require publication?

Eight states require some form of legal-notice publication for LLC formation, DBA filings, or other corporate filings: New York, Pennsylvania, Georgia, Illinois, Minnesota, Nebraska, Florida (DBA only), and California (DBA only). Requirements vary by state.

How much does publication cost?

Costs range from $40 (low-circulation rural papers) to $1,500+ (Manhattan dailies). New York requires 6 weeks in 2 newspapers (one daily, one weekly). Pennsylvania requires 2 newspapers. Most other states require 4 consecutive weeks in one paper.

Can I pick any newspaper?

No. Each county designates approved legal-notice newspapers. The state Secretary of State office (or county clerk) maintains the list. Using an unapproved paper means the publication does not satisfy the requirement.

What happens if I do not publish?

New York: LLC loses authority to bring lawsuits in NY courts until publication is completed. Pennsylvania: state may reject the formation. Georgia: corporate name protection lapses. Each state has different consequences; all bad.
