Common questions.

Do I need an LLC if I just post on social media?
When you start signing sponsorship contracts, getting paid for content, or have any personal assets to protect, yes. Influencer income generates legal exposure: contract disputes, IP claims, defamation, FTC compliance.
Can I trademark my personal name?
Sometimes. Personal names can be trademarked if they have acquired distinctiveness through use in commerce (you are well-known by that name). Handles and brand marks are easier to register.
What is FTC disclosure?
Federal Trade Commission requires creators to clearly disclose sponsored content. "#ad" or "Paid partnership with X" at the start of the post is standard. Our contracts include FTC compliance language for sponsors.
Should I use my real name or a brand name?
Either works. If you use a brand name distinct from your legal name, file a DBA under your LLC. If you use your real name, the trademark application can use your personal name with distinctiveness evidence.
What about privacy from fans or stalkers?

Can I deduct content production costs?
Yes. Camera equipment, lighting, microphones, editing software, travel for content, home studio space (with limits) are deductible business expenses through the LLC.
How do I handle merchandise sales?
Treat merch as ecommerce: sales tax registration in nexus states, books integration with Shopify, federal trademark on merch brand. Sometimes a separate LLC for merch makes sense if it scales significantly.
What about brand partnerships with foreign companies?
Foreign brand wires usually clear through US banking partners. Sometimes withholding tax applies. Specialty CPAs handle this.
Should I form a Delaware C-Corp?
Only if you plan to raise outside capital (rare for influencers). Most influencers stay LLC.
